Representing an Individual in an oil and gas dispute. Scott Clearman and Brian Walsh obtained a settlement of $4.7 million for a client in a dispute over the rights to proceeds from an offshore oil and gas property. The settlement has not yet been paid. The attorneys' fees and expenses will be no more than 33% of the settlement, if paid as agreed. Thus, the attorneys' fee and expenses will be $1.551 million.
Representing a Public Company as National Counsel. Scott Clearman and Brian Walsh represented an orthodontic practice management company and successfully defended their client against a group of approximately 65 orthodontists in over 35 lawsuits pending in various federal and state courts throughout the country.
Representing Hospitals in a Medicare Dispute. Brian Walsh and Scott Clearman recently represented five Texas hospital systems against Aetna in an appeal to the Supreme Court of Texas over a state court’s jurisdiction to hear claims for Medicare reimbursement totaling more than $13 million. They persuaded the Supreme Court of Texas to reverse the trial court and the court of appeals. The case is now set for trial in November.
Representing an Individual Denied Life Insurance Benefits. Scott Clearman represented a wife who was denied the death benefits under a life insurance policy insuring her husband’s life. The total recovery was $1.45 million, more than the face value of the policy. Net of attorneys’ fees and expenses of $512,000, the client received $983,000.
