The attorneys at The Clearman Law Firm have recovered more than $308 million for our clients and class members.  After payment of attorneys’ fees and expenses of $90 million, our clients and class members received settlements or collections totaling $290 million.

Representing Businesses in Class Actions.  Scott Clearman has served as lead counsel in three class actions representing large businesses that paid more for worker’s compensation insurance than allowed by the law.  The aggregate recovery for the classes was in excess of $277 million.  Net of attorneys’ fees and expenses of $77.98 million, the class members received more than $195 million.

Representing ERISA Beneficiaries.  Brian Walsh and Scott Clearman served as co-lead counsel in a suit by ERISA plan participants against Dynegy.  They recovered $9.975 million on behalf of the class.  Net of attorneys’ fees and expenses of $2.495 million, the class received $7.48 million. 

Representing Families of Employees Insured under Corporate Owned Life Insurance.  Scott Clearman and Brian Walsh have obtained settlements of over $19.4 million for the families of deceased Wal-Mart and Fina employees after the companies purchased life insurance policies covering those employees.  Net of attorney's fees and expenses of $6.44 million, the classes received $12.86 million.   

 



Representing an Individual in an oil and gas dispute.  Scott Clearman and Brian Walsh obtained a settlement of $4.7 million for a client in a dispute over the rights to proceeds from an offshore oil and gas property.  The settlement has not yet been paid.  The attorneys' fees and expenses will be no more than 33% of the settlement, if paid as agreed.  Thus, the attorneys' fee and expenses will be $1.551 million. 

Representing a Public Company as National Counsel.  Scott Clearman and Brian Walsh represented an orthodontic practice management company and successfully defended their client against a group of approximately 65 orthodontists in over 35 lawsuits pending in various federal and state courts throughout the country.  

Representing Hospitals in a Medicare Dispute.  Brian Walsh and Scott Clearman recently represented five Texas hospital systems against Aetna in an appeal to the Supreme Court of Texas over a state court’s jurisdiction to hear claims for Medicare reimbursement totaling more than $13 million.  They persuaded the Supreme Court of Texas to reverse the trial court and the court of appeals.  The case is now set for trial in November.

Representing an Individual Denied Life Insurance Benefits.  Scott Clearman represented a wife who was denied the death benefits under a life insurance policy insuring her husband’s life.  The total recovery was $1.45 million, more than the face value of the policy.  Net of attorneys’ fees and expenses of $512,000, the client received $983,000.
